2008 Due Dates for Returns all Business Types

Tax return due dates vary depending on what type of business organization you have chosen. Tax return due dates are different for the various types of business organizations.

Sole Proprietorships (unincorporated)

Sole proprietorships that are not incorporated file taxes with the owner’s personal tax returns. Their tax year, just like the owners, ended on December 31, 2008. They have until April 15, 2009 to file their federal and state tax return unless they file an extension.

Partnerships

A partnership return, Federal Form 1065, is an informational return since tax is owed by the individual partners. The tax year ended on December 31, 2008 and the return is due, along with the partner’s returns, on April 15, 2009. The partners file a K-1 return on April 15 which shows their share of the income or loss in the partnership.

Limited Liability Companies

Single-member limited liability companies file taxes like sole proprietorships. The tax year ended December 31, 2008 and the filing deadline is April 15, 2009. Multiple-member limited liability companies conform to the rules of partnerships stated above.

Corporations

A C-corporation may elect the end of their own fiscal or financial year. The corporation usually chooses the end of a quarter for the end of their fiscal year. If a corporation chooses the end of a quarter, taxes are due and payable the 15th of the third month after the end of that quarter. If the corporation, for example, chooses September 30 as the end of their fiscal year, then the corporation must file and pay their taxes by December 30 of that year.

Subchapter S Corporations

Since the profits or losses of a Subchapter S Corporation are claimed on individual returns, the tax year for this type of corporation usually ends on December 31. Like other corporations, Subchapter S Corporations have to file three months hence on the 15th day of the month, which would be March 15.
